Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ZenithAlign mobile application (iOS) and website (collectively, the “Service”) provided by ZenithAlign (“Company,” “we,” “us,” or “our”). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Arbitration Notice: These Terms include a binding arbitration clause and class action waiver. Please read Section 17 carefully.

1. Eligibility and Account Registration

  • You must be at least 17 years old to use the Service (consistent with our App Store age rating).
  • By using the Service, you represent that you have the legal capacity to enter into a binding agreement.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must provide accurate, current, and complete information during registration and keep your account information updated.
  • You may not create more than one account per person. Duplicate accounts may be suspended.
  • If you sign in with Apple, your account is also subject to Apple’s Terms and Conditions.

2. The Service — Description and Scope

ZenithAlign provides a spiritual wellness platform including, but not limited to:

  • Tarot Readings: Personalized tarot card readings delivered by vetted human readers or AI systems.
  • AI Guidance (Astra): AI-powered spiritual guidance, cosmic interpretation, and conversational support.
  • Dream Interpretation: AI-assisted analysis and symbolic interpretation of user-submitted dream descriptions.
  • Breathing & Meditation: Guided breathing exercises and meditation sessions.
  • Content Library: Articles, rituals, and educational material on astrology, tarot, and spiritual practice.

The features available to you depend on your subscription plan. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

3. In-App Purchases, Subscriptions & Coins

3.1 Subscriptions

  • ZenithAlign offers auto-renewable subscription plans (monthly, quarterly, annual) purchased through Apple’s in-app purchase system (StoreKit).
  • Subscription pricing, duration, and included features are clearly displayed before purchase and on the App Store product page.
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Free trials, where offered, convert to paid subscriptions unless cancelled before the trial ends. You will not be charged during the trial period.
  • To cancel: Go to iOS Settings → [Your Name] → Subscriptions → ZenithAlign → Cancel Subscription. Cancellation via email or in-app messages alone is not sufficient.

3.2 Coins (In-App Currency)

  • Coins are a virtual in-app currency used to access premium features, human reader sessions, and AI consultations.
  • Coins are purchased via Apple’s in-app purchase system. Prices are displayed in your local currency at the time of purchase.
  • Coins have no cash value and cannot be transferred, gifted, or refunded.
  • Unused Coins may expire as described in the app. We will provide advance notice of any expiration policy changes.

3.3 Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. ZenithAlign does not process refunds directly and is not responsible for Apple’s refund decisions.

4. Entertainment Disclaimer — Spiritual Content

IMPORTANT: All content provided by ZenithAlign — including tarot readings, AI guidance, astrological interpretations, dream analyses, and meditation guidance — is provided for entertainment, personal exploration, and spiritual wellness purposes only.

ZenithAlign content is NOT a substitute for and should not be relied upon as:

  • Professional medical, psychiatric, or psychological advice, diagnosis, or treatment
  • Legal advice or counsel
  • Financial, investment, or economic advice
  • Any other form of licensed professional service

If you are experiencing a mental health crisis, medical emergency, or other serious situation, please contact appropriate emergency services or a licensed professional immediately.

5. Artificial Intelligence — Disclosures and Limitations

  • AI-generated content (including Astra guidance, dream interpretations, and automated readings) is produced by machine learning models and does not represent the views, opinions, or advice of any human professional.
  • AI responses may be inaccurate, incomplete, or inappropriate for your specific situation. You should apply your own judgment to any AI-generated content.
  • We disclose within the app when a response is AI-generated versus delivered by a human reader.
  • Transmitting personal information to AI features requires your explicit consent, as detailed in our Privacy Policy. You may withdraw consent at any time in app Settings.
  • We do not guarantee the availability, accuracy, or suitability of AI features for any particular purpose.

6. Human Reader Services

  • Human readers on ZenithAlign are independent practitioners who have agreed to our Reader Code of Conduct. They are not employees or agents of ZenithAlign.
  • Reader response times are estimates only. We aim for delivery within the stated timeframe but do not guarantee specific response times.
  • ZenithAlign does not guarantee the accuracy, completeness, or fitness for purpose of any reading delivered by a human reader.
  • If a reader is unable to fulfill a session, you will receive a full Coin refund or an equivalent credit.
  • Any disputes with a human reader should be reported to support@zenithalign.com.

7. User Conduct and Prohibited Activities

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Submit content that is abusive, harassing, threatening, defamatory, obscene, or hateful
  • Attempt to reverse-engineer, decompile, or extract source code from the app
  • Use automated bots, scrapers, or other tools to access the Service without authorization
  • Attempt to circumvent, disable, or interfere with security features of the Service
  • Share your account credentials with others or allow others to use your account
  • Upload malicious code, viruses, or any software designed to disrupt the Service
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Purchase, sell, or transfer Coins or virtual currency outside of authorized mechanisms
  • Use the Service to collect or harvest other users’ personal information

Violations may result in immediate suspension or termination of your account without refund.

8. User-Generated Content

By submitting content to the Service (dream entries, questions, reviews, etc.), you grant ZenithAlign a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, and display that content solely for the purpose of providing and improving the Service.

You represent that you own or have the necessary rights to submit such content, and that it does not infringe any third-party rights. You retain ownership of your content. We do not claim ownership over your personal dream journals or reading histories.

We reserve the right to remove any content that violates these Terms or our community standards, without notice.

9. Intellectual Property

All content, features, functionality, design, trademarks, logos, and software comprising the Service are owned by ZenithAlign or our licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes. This license does not include the right to copy, modify, distribute, sell, or create derivative works from any Service content.

The ZenithAlign name, logo, and “Astra” mark are trademarks of ZenithAlign. Unauthorized use is prohibited.

10. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy, which is incorporated into these Terms by reference.

11. Third-Party Links and Services

The Service may contain links to third-party websites or services, including Apple’s App Store, external payment processors, and partner platforms. These links are provided for convenience only. ZenithAlign does not control, endorse, or assume responsibility for any third-party content, products, or services. Your use of third-party services is governed by their own terms and policies.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.

ZENITHALIGN DOES NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZENITHALIGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OF OR INABILITY TO USE THE SERVICE; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (III) ANY DECISIONS MADE IN RELIANCE ON CONTENT PROVIDED THROUGH THE SERVICE.

IN NO EVENT SHALL ZENITHALIGN’S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ZENITHALIGN IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

14. Indemnification

You agree to indemnify, defend, and hold harmless ZenithAlign and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.

15. Account Termination

  • By You: You may delete your account at any time via Settings → Account → Delete Account. Subscription cancellation must be done separately through iOS Settings.
  • By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.
  • Upon termination, your right to use the Service ceases immediately. Any Coins or subscription time remaining will be forfeited without compensation, except where required by law.
  • Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and arbitration) shall survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. If you are located in the EEA or UK, mandatory consumer protection laws of your country of residence may also apply.

17. Dispute Resolution — Binding Arbitration

Please read this section carefully. It affects your rights.

Except for claims that qualify for small claims court, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration shall take place on an individual basis. Class actions and class arbitrations are not permitted.
  • The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
  • Notwithstanding the above, either party may seek injunctive or other equitable relief in court for intellectual property infringement.

If you are located in the EEA, you may also have the right to lodge a complaint with your local data protection authority and to use the EU’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18. Changes to Terms

We may revise these Terms from time to time. If we make material changes, we will notify you at least 14 days before the new terms take effect, via in-app notification and/or email. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you do not agree to revised Terms, you must stop using the Service and cancel any active subscriptions before the effective date.

19. Apple-Specific Terms (EULA)

The following terms apply specifically to your use of the ZenithAlign iOS app downloaded from the Apple App Store:

  • These Terms are an agreement between you and ZenithAlign only, not with Apple Inc. Apple is not responsible for the app or its content.
  • Apple has no obligation whatsoever to provide any maintenance or support services for ZenithAlign.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligations.
  • Apple is not responsible for addressing any claims relating to the app or your possession/use of the app, including product liability, consumer protection, intellectual property infringement, or third-party claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
  • You represent that you are not located in a country subject to U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited parties.
